Terms & conditions

These terms apply when you book travel through Gracy Travel International Inc. If anything here is unclear, call us on +1 210 698 2611 before you book — we would rather explain it than have you agree to something you haven’t read.

Travel advice

Travel to many parts of the world may involve the risk of a variety of hazards to health and/or safety, including but not limited to disease, crime, terrorism and warfare. Because each guest’s risk tolerance is different, Gracy Travel is not in a position to advise or recommend whether travel to any particular place at any particular time should take place. It is recommended that the guest should refer to objective third-party sources of travel information, such as that maintained by the U.S. Department of State (travel.state.gov). In addition, you should consult with government websites to ensure that you are in compliance with all requirements for admittance into that country as well as understanding local laws that govern travel within a country, such as medical tests and tracking. Should you choose to travel to a country that has been issued a travel warning or advisory, Gracy Travel will not be liable for damages or losses that result from travel to such destinations.

Using our service

We provide our Service to help you find information about Travel Services and to assist you in booking those Travel Services. It is provided to you for no other purpose.

You agree that:

  • you will only use our Service for personal and non-commercial purposes
  • you must be at least 18 years of age and have the legal authority to enter into contracts
  • you will use our Service lawfully and in compliance with these Terms
  • all information supplied by you is true, accurate, current and complete

If you book on behalf of others:

  • you will obtain their authorization prior to acting on their behalf
  • you will inform them about the terms that apply to the booking (including the Rules and Restrictions) and ensure that they agree to such terms
  • you are responsible for paying any amounts due, for making any change or cancellation requests and for all other matters relating to the booking.

You also agree not to:

  • make any false or fraudulent booking
  • access, monitor or copy any content on our Service using any robot, spider, scraper or other automated means or any manual process
  • violate the restrictions in any robot exclusion headers on our Service or bypass or circumvent other measures employed to prevent or limit access to our Service.

We may deny our service to anyone at any time for any valid reason. We may also make improvements and changes to our Service at any time.

Fare quotes and rates

Prices for Travel Services are dynamic and can change at any time. Price changes will not affect bookings already paid for, except in cases of obvious error. We book many Travel Services, and we try hard to ensure that the price we quote is accurate. We reserve the right to correct any pricing errors in our quotes.

If there is an obvious error and you have made a purchase, we will offer you the opportunity to keep your booking by paying the correct price or we will cancel your booking without penalty. We have no obligation to make available Travel Services to you at an incorrect (lower) price even after you have been sent a Purchase Confirmation, if the error should reasonably have been apparent to you. Simply providing your credit card information to us does not constitute a purchase. Prices for Travel Services can change up to the moment of purchase.

The information you provide to us

It is the client’s sole responsibility to provide us with names of passengers that match the guests’ passports at the time of travel, dates of birth and complete passport details to secure the bookings. Any minor name corrections advised after airline tickets have been issued will incur fees. Not all name corrections will be permitted by airlines and may require the purchase of a new ticket. Clients voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report correct information to Gracy Travel.

Passports, visas and permits

It is the traveler’s or client’s sole responsibility to obtain and have available when necessary the appropriate valid travel documents and permits. All travelers are advised to check with the appropriate government authority to determine the necessary documents required for their travel. A valid passport is required for U.S. and Canadian citizens traveling to all international destinations. Passports must be valid for six (6) months after completion of your journey and should also have sufficient blank visa pages for entry and exit stamps. Many destinations also require a visa for U.S. and Canadian citizens; this will be indicated in your Pre-Travel Documentation. Citizens of other countries should contact the appropriate consular office for entry requirements pertaining to their journey. You may be refused boarding or disembarked from a plane, vessel or train without liability for refund, payment, compensation, or credit of any kind if you do not have proper documentation. Gracy Travel shall not be responsible should any guest be denied entry to a country due to noncompliance with these requirements.

Gracy Travel may assist you in obtaining your visas and firearm permits. The issuing authority will make the final determination as to the type of visa or permit, how quickly it will be issued and for what duration it will be issued. Prior to approval, the issuing authority may ask for additional documentation. The issuing authority may reject any visa, permit or other document application for any reason and may not provide a reason to Gracy Travel for the rejection. Gracy Travel does not issue visas or permits and therefore cannot make any guarantee or assurances that any issuing authority will issue any document. Gracy Travel cannot guarantee the time required for an issuing authority to grant or reject an application. Issuing authorities may choose to grant a different type of visa, permit or other travel document than that which the applicant has requested, which may impact the purpose, validity or number of entries. As a result, if you choose to purchase any non-refundable tickets or reservations, you do so with the understanding that you may not get any refund if the visas and/or permits are not granted.

Gracy Travel reserves the right to prioritize processing requests according to the travel dates provided. Gracy Travel service fees are assessed for taking reasonable actions to foster the issuance of requested travel documents. Gracy Travel will use its best endeavors to process applications for visas, permits and/or documents at the client’s request. However, Gracy Travel shall not be held responsible for, nor will accept any liability for, the actions of any consulate, embassy, or passport office in delaying or not issuing such applications for any reason whatsoever. In addition, Gracy Travel shall not be held responsible for expense and/or delay arising from or in connection with: (a) incomplete application forms, (b) incorrectly or falsely completed application forms, or (c) inaccurate or incomplete supporting documentation. Any expense or cost incurred by the client due to these delays or non-issuances shall not be the responsibility of, nor shall any charges be levied upon, Gracy Travel.

Gracy Travel provides visa, passport and permit information in good faith and on the express understanding that the said information is the interpretation of any or all information provided by respective embassies, consulates, passport offices or police authorities at any or all times, and Gracy Travel shall not accept responsibility or liability whatsoever for any errors and/or omissions in the information. Gracy Travel will endeavor, wherever possible, to process the client’s visa, passport and/or permit documents based on the instructions given and application forms submitted, although it is the client’s express responsibility to ensure that the validity of the said visa, passport or permit obtained includes and covers the periods of time in which the client plans to enter and leave the country or countries that the client is visiting, and for the number of entries to that country, and is valid for the purpose intended.

When Gracy Travel returns your passport and documents, it is your responsibility to verify that all the visas and permits you require for your trip have been obtained, that they are valid for the entry and exit dates of your visit, that your personal details are reflected accurately, and that your passport is valid for at least six (6) months beyond the completion of your trip. Please note that even when a visa or permit is issued, a traveler may be denied entry, since in each country the local immigration officials make the final entry decision. Firearm permits are issued upon and are subject to physical inspection of your firearm. The authorities may decline to issue the permit.

Pre-approval for firearms

Gracy Travel shall assist in pre-approving your firearms with the airlines if you advise us that you are traveling with firearms and submit complete information about firearms and ammunition. The airline’s decision to accept your firearms is subject to final inspection of your firearms and ammunition at the time of airport check-in. Final determination will be made by the airline, transportation or airport authority, or government authority after all inspection and document review at the airport.

The airlines may decline to accept your firearms, ammunition and/or any sports equipment even if pre-approval was issued. Airlines, transportation or airport authorities, government authorities or other entities may choose to hold, seize or confiscate firearms or any other weapons at their discretion. Gracy Travel shall not be held responsible for, nor will accept any liability for, the actions of any airline, transportation or airport authority, government authority or other entity that may deny acceptance of, offload, hold, seize or confiscate any firearms, ammunition and/or sports equipment.

Payment processing and merchants of record

For certain Travel Services, payment may be charged by more than one party (as will be shown on your payment method statement); however, the total amount charged will not exceed the total price of all the Travel Services. In many cases your card may be charged by an airline, hotel or other travel supplier. When providing your credit card information to Gracy Travel and/or making a purchase from Gracy Travel, you authorize Gracy Travel, its third-party payment processors and its suppliers to charge your credit card. The name of the merchant or third-party processor may not be familiar to you.

When payment is taken at the time of your booking and paid for in the local currency of our Service (as relevant), another company may be taking that payment and charging your payment method. You authorize the relevant third-party processor or the Travel Provider to:

  • verify your payment method by obtaining a pre-authorization, charging a nominal fee or through other verification means, and
  • on verification, charge your payment method.

Fees charged by banks

Some banks and card issuers impose fees for international or cross-border transactions. For example, if you make a booking using a card issued in a different country from the Travel Provider’s location, or you choose to transact in a currency that is different from the local currency of our Service, your card issuer may charge you an international or cross-border transaction fee.

Also, some banks and card issuers impose fees for currency conversion. For example, if you make a booking in a currency different from the currency of your credit card, your card issuer may convert the booking amount to the currency of your credit card and charge you a conversion fee.

If you have any questions about these fees or the exchange rate applied to your booking, please contact your bank or card issuer. Our group of companies is not associated with, or responsible for, any fees relating to varying exchange rates and card issuer fees.

Fraud, suspicious activity and card disputes

If a booking or account shows signs of fraud, abuse, association with a government-sanctioned person or entity, or other suspicious activity, we may request extra information from you. If we reasonably conclude that a booking or account is associated with fraud or suspicious activity, we may:

  • cancel any bookings associated with your name, email address or account
  • close any associated accounts, and
  • take legal action, including to seek to hold you liable for any loss.

You agree not to dispute any credit card charge that reasonably results from a valid purchase you made from Gracy Travel. If you do knowingly or unknowingly dispute a valid charge which resulted from your purchase from Gracy Travel, you accept responsibility for fees or additional costs that result from that dispute. Gracy Travel and its suppliers may cancel any service that is fully or partially paid for by a disputed charge. Disputing a charge does not constitute a request for cancellation of the services. You remain liable for any services canceled as a result of a credit card dispute, even if they were not provided.

Airline schedule changes

You understand and agree that:

  • airlines ultimately control their schedules, and they may change or cancel your flight for a variety of reasons (for example, mechanical problems or adverse weather). Whenever the airline gives us information about a change or cancellation to your itinerary, we will pass it on to you and help you assess your options. You should always check the scheduled departure time of your flight before travel
  • airlines control seating and we do not guarantee the availability of specific seats, even when pre-booked
  • if you book a return flight and do not use the outward flight, the airline may cancel the return flight without refund
  • for special or charter flights, the airline, the flight schedule, the aircraft type, the itinerary and possible stops are given as an indication only. These specifics may be subject to change even after confirmation
  • some airlines impose extra charges for meals, luggage and preferred seat selection. Any reference to these extra optional services and related charges shown through our Service is for information only and may be updated by airlines at any time
  • you must follow the relevant Rules and Restrictions on the carriage of children. Children older than 2 on the return date must have a return ticket at a child fare for both the outbound and inbound flights. You will not be eligible for a refund of any seat charges incurred during travel if you do not comply. Children aged under 2 will not be allocated their own seat unless a child fare is booked for them. Unaccompanied children under 14 will only be allowed to fly in line with the relevant Rules and Restrictions
  • the carriage of hazardous materials aboard aircraft in your luggage or on your person is generally forbidden.

Combined one-way tickets, air miles and airline liability

We may offer you the opportunity to book two one-way tickets instead of a roundtrip ticket. Combined one-way tickets may provide a greater choice of flights. They are often cheaper and can be combined on the same airline or on different airlines. Unlike roundtrip tickets, each one-way ticket is subject to its own Rules and Restrictions. If one of these flights is affected by an airline change (such as cancellation or rescheduling), then you may have to make changes to the other flight. In such instances you will be responsible for any charges or fees incurred for making changes to the unaffected flight.

Air miles and vouchers from loyalty programs may not be used when booking flights through our Service.

Law, treaties and the airline’s own Rules and Restrictions normally limit an airline’s liability for death, personal injury and other damages. Flights booked with one airline are sometimes operated by another airline. When different, details of the operating airline are shown through our Service. The airline that issues your ticket will charge you for your flight and will appear on your payment method statement.

In case of a no-show or cancellation, you may be entitled to a refund of airport taxes and fees included in the price of the flight purchased. In this instance you can request such a refund from us, and we will submit your request to the airline on your behalf.

Assistance with award bookings

Gracy Travel may provide advice and assistance in making award bookings and upgrades. It is your responsibility to familiarize yourself with the terms and conditions of all the award programs you request our assistance with. You confirm that you are the holder of the account, or are authorized by the holder to make changes and redemptions from the account. You agree that any mileage transfers and/or redemptions you make, or authorize us to make on your behalf, are with full understanding of all rules and conditions that govern the award programs. When providing your account information to us, you authorize us to act on your behalf to make any redemptions, changes or transfers. Your account information shall be handled in accordance with our privacy policy and in accordance with these Terms.

Our fees cover our advice and consulting services, and are independent of any provider-imposed charges. We sell no miles, and we advise our clients against working with any third-party agencies that broker miles or otherwise violate the terms of the respective frequent flyer program. Mileage fare quote estimates are based on currently available public information and may change prior to your trip. Any estimates are based on the mileage and dollar earning rates at the time of booking. Award availability is dynamic and may change at any time.

Checking your travel confirmations

Gracy Travel staff shall make every effort to collect the details of your trip. Whenever possible we will send emails with full itinerary details before purchasing tickets and/or prepaying any arrangements. Clients receive a complete travel recap after the purchase is made, as well as a digital travel packet within a couple of weeks before departure.

The client is responsible for carefully studying any travel confirmations, recaps and digital packets received from Gracy Travel and reporting any inaccuracies within 24 hours of receipt of the document. It is the client’s responsibility to contact Gracy Travel if a recap is not received within 24 hours of initial purchase, or if a digital packet is not received within 7 days of departure. Clients voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report any errors and/or omissions on documentation to Gracy Travel within the stated time limits.

Refunds

Our service fees and any travel arrangements we make are non-refundable once paid for. Some airlines and travel suppliers allow refunds if certain conditions are met. We will make every effort to obtain for you all possible refunds as provided under airline, hotel and tour operator fare rules, contracts of carriage, and terms and conditions, but we cannot guarantee any specific outcome. Gracy Travel shall not be held responsible for, nor will accept any liability for, the failure of any airline or other travel supplier to provide refunds.

We do not guarantee that the fees paid in exchange for the services we provide are refundable. They may be fully refundable, partially refundable or non-refundable, depending on the type and nature of the ticket or booking. The refundability of our service fees will be determined within the framework of our agreement with you.

Acknowledgement and assumption of risk

Additional risks and dangers may arise including, but not limited to, hazards of travel by train, automobile, motor coach, aircraft, balloon, ship and other means of conveyance; animal interactions; forces of nature; political and other unrest; risks associated with water, food, plants and insects; differing animal regulation; and acts of national and local governments and acts of others against governments. These risks are not an exhaustive list but are examples of many kinds of risks.

You are voluntarily participating in these activities with the knowledge that there are significant dangers involved, and you hereby agree to accept any and all risks. As lawful consideration for the agreement with Gracy Travel to participate in such trips and activities, you agree that you will not make a claim against Gracy Travel, its related companies or its personnel, or sue for bodily injury, emotional trauma, death, property loss or damage, or other loss, cost or expense, however caused, as a result of or related to your contracting for, traveling to or from, or in any and every other way participating in the trip. You release Gracy Travel, its related companies and its personnel from any and all claims, known or unknown, arising from contracting for, traveling to or from, and in any and every way participating in a trip. This release of liability and assumption of risk agreement is entered into on behalf of you and all members of your family and party, including minors. This agreement also binds your heirs, legal representatives and assigns.

For any car transfers Gracy Travel books, where the client occupies a seat fitted with a safety belt, neither Gracy Travel nor the supplier nor its agents or co-operating organizations or service providers will be liable for any injury, illness or death, or for any loss, damages or claims whatsoever arising from any accident or incident, if the safety belt is not being worn at the time of such an accident or incident.

General disclaimer

gracytravel.com and its affiliated websites, channels, email properties and other online services (collectively, the “Sites”) are owned and operated by Gracy Travel International and its affiliates (the “Company”, “we”, “our”, or “us”). Access to and use of the Sites is subject to these terms and conditions of use. “Sites”, or any content owned by the Company, shall include any information or services made available by the Company, regardless of the medium, and shall include without limitation any affiliated websites, communication channels, software, products, mobile applications and videos we make available.

The Company reserves the right at any time, and from time to time, to erase, destroy, edit, modify, suspend or temporarily or permanently discontinue the Sites, or any part of the Sites, with or without notice. Access to the Sites may not be legal by certain persons or in certain jurisdictions. In the case of access to the Sites from outside the United States, the party who is accessing does so on their own initiative and is responsible for compliance with applicable local laws and regulations.

Any statement, news or information, whether objective or subjective, and any data, fact, assumption or prediction on the Sites, represents the Company’s current findings or opinions on the respective subjects. The Company accepts no liability or responsibility for any kind of damage that may arise from any false notion, misguidance or mistake regarding the foregoing. We publish and issue our Sites with the expectation and understanding that each receiver of the information contained herein will also make their own study and evaluation, in a deliberate, cautious and prudent way, of each notion that is under consideration for any kind of decision.

All information provided to you is and will be obtained by the Company from sources, databases and software believed by it to be accurate, up to date and reliable. Because of the possibility of human or mechanical error, as well as other factors, all information provided during our services is provided “as is”, without representation of accuracy or any kind of warranty, obligation, commitment or undertaking. The Company adopts all reasonable measures so that the information used is of sufficient quality.

Under no circumstances shall the Company have any liability or responsibility to any person or entity for any kind of loss or damage, in whole or in part, caused by, resulting from, or relating to any error (negligent or otherwise) or other circumstance or contingency within or outside our control, in connection with the procurement, collection, compilation, analysis, interpretation, communication, publication or delivery of any such information; or for any direct, indirect, special, consequential, compensatory or incidental damages whatsoever (including without limitation loss of profits), even if we are advised in advance of the possibility of such damages, resulting from the use of, or inability to use, any such services or information.

No warranty, express or implied, as to the accuracy, timeliness, completeness, merchantability or fitness for any particular purpose of any such service, application, information or registration is given or made by the Company in any form or manner whatsoever. You hereby waive any and all claims against the Company and any of its subsidiaries, divisions, affiliates, employees, shareholders, equity owners, managers, agents, representatives and licensors (including independent contractors) arising out of your use of our services and our Sites and the information available thereon.

The Company does not guarantee the success of any application, registration or process to be made or consulted in relation to licenses, onboarding, permits and registrations, and no indirect or direct material or moral damage can be claimed against us. You hereby unilaterally and irrevocably waive all of the above-mentioned claims.

Our right to modify these terms

We reserve the right to change these terms at any time. You and every third-party user are expected to check gracytravel.com regularly for the current version. Continued use of the Sites after a change constitutes acceptance of the revised terms.
